Summary

Acting Chair Lucas announces that defending "the biological and binary reality of sex" is an EEOC enforcement priority; removes the "X" gender marker option and the "Mx." prefix from discrimination charge intake forms; disables the Microsoft 365 pronoun-display feature for agency staff; and removes "gender ideology" materials from EEOC internal and external websites, documents, forms, and trainings (see section 12). Lucas also announces opposition to the portions of the EEOC's April 2024 Enforcement Guidance on Harassment that treat denial of access to sex-segregated facilities consistent with gender identity as harassment, asserting the guidance exceeded Bostock.

Status

In effect. Lucas was subsequently renominated and now serves as confirmed Chair. The gender-identity portions of the 2024 harassment guidance were vacated by Judge Matthew Kacsmaryk in State of Texas v. EEOC, No. 2:24-cv-00173 (N.D. Tex.) (decision May 15, 2025; case closed May 22, 2025); the administration did not appeal.
