Summary
Eight days into the administration, OCR notified Denver Public Schools it had opened a "directed investigation" (agency-initiated, without a complainant) into East High School's conversion of a second-floor girls' restroom into an all-gender, multi-stall restroom, asserting the change left "no restroom for female students" on that floor in violation of Title IX. It was OCR's first directed investigation of the term aimed at a trans-inclusive facility policy and signaled the new enforcement theory that gender-neutral facilities themselves violate Title IX.
Status
OCR later announced a finding that the all-gender bathrooms violate Title IX (reported by NBC News, 2025); no resolution agreement or funding action against DPS has been publicly announced as of August 2026.
