Summary
Implementing EO 14190's parental-rights directives (see section 1), SPPO's Dear Colleague letter told state and local education agencies that withholding from parents records about a student's gender identity at school - specifically "gender plans" and gender-support documents - violates parents' FERPA right of access, and that surveys touching on gender may trigger PPRA consent rules. It ordered every state education agency to submit documentation by April 30, 2025 substantiating that its districts' policies comply, converting a privacy statute into a reporting-and-audit mechanism aimed at trans-supportive confidentiality practices.
Status
In effect; the certification demand and subsequent SPPO investigations (California, Kansas districts, Washington) build on it.
