- Actor
- President; Department of Education
- Agency
- Department of Education (ED)
- Type
- Executive order
Summary
Directs the Secretary of Education to exclude from Public Service Loan Forgiveness "qualifying employer" status organizations with a "substantial illegal purpose," expressly enumerating "child abuse, including the chemical and surgical castration or mutilation of children or the trafficking of children to so-called transgender sanctuary States for purposes of emancipation from their lawful parents." The definition targets hospitals, clinics, and nonprofits connected to gender-affirming care for minors, making their employees' federal loan forgiveness ineligible. EO number 14235; 90 FR 11885 (Mar. 12, 2025).
Status
The EO stands, but its implementing rule was vacated and never took effect. ED published the final rule October 30-31, 2025 with a July 1, 2026 effective date. On June 30, 2026 — the day before it would have taken effect — Judge Myong J. Joun (D. Mass.) vacated the rule in its entirety, holding it contrary to the unambiguous text of the PSLF statute, in excess of the Department's authority, arbitrary and capricious, and violative of the First Amendment; a parallel D.D.C. ruling vacated it the same day. No PSLF employer has been disqualified under this authority. The EO itself remains unrevoked, so ED retains the option of a new rulemaking (see sections 5, 9).
