SUPPLEMENT: STATE DEPARTMENT: THE LGBTQI+ HUMAN-RIGHTS OFFICE STRUCTURE AND THE REFUGEE RESETTLEMENT PATHWAY — PLUS PRESIDENTIAL DETERMINATIONS AS A MISSING INSTRUMENT TYPE

Summary

EO 14163 ("Realigning the United States Refugee Admissions Program") suspends entry of refugees under USRAP effective 12:01 a.m. EST January 27, 2025, on a finding that refugee entry "would be detrimental to the interests of the United States," with admissions permitted only where the Secretaries of State and Homeland Security jointly determine case-by-case that an individual's admission is in the national interest. DHS must report every 90 days on whether resumption is in U.S. interests, and the order directs greater state and local involvement in placement decisions. Because the only dedicated LGBTQI+ resettlement routes were P-1 individual referrals — by the Special Envoy, by the DRL Assistant Secretary under a PRM pilot, and by designated NGOs — the suspension terminated the pathway in operation even though no instrument named it. Status

In effect. The Ninth Circuit held on March 5, 2026 that the President acted within his § 1182(f) authority in suspending admissions and in pausing decisions on pending applications, reversing the district-court injunctions on those points.
