Summary
In a suit filed May 20, 2025 by Lambda Legal on behalf of GLMA and 16 researchers whose grants were terminated or applications withheld, the court granted a preliminary injunction on August 1, 2025 blocking NIH from terminating LGBTQI+ health research grants as to plaintiffs, finding the terminations likely unconstitutional discrimination under Fifth Amendment equal protection and unlawful under Section 1557 of the ACA — a discrimination holding distinct from APHA's APA theory. The court cited the pattern: 669 grants cancelled or reduced, at least 323 addressing sexual- and gender-minority health, over $800 million. (See also section 10.)
Status
Preliminary injunction in effect; case in merits discovery before Judge Lydia Kay Griggsby (administrative record filed January 9, 2026; amended scheduling order June 30, 2026; joint status report due October 30, 2026).
