Summary
In mid-July 2026, on the D.C. Circuit's mandate, the roughly 30 enlisted Talbott plaintiffs were cleared to serve again. Relief did not extend to the full certified class: separated non-plaintiff members awaited class-wide implementation, transgender civilians still could not enlist (the D.C. Circuit expressly left the accession bar enforceable), and the Pentagon continued to refuse to disclose how many members it had separated or placed on administrative leave. California legislators moved to create state assistance for separated transgender troops, citing the federal government's refusal to account for those it removed.
Status
Named plaintiffs cleared to serve; class-wide relief, treatment of already-separated members (back pay, records correction, reinstatement), and accession policy unresolved as of Aug. 20, 2026. ⚠️ Precision caveat: the operative relief is an injunction barring separation, which is prospective. Contemporaneous reporting describing plaintiffs as "returning to service" is ambiguous as between members who were never separated and members restored from separation, and GLAD Law's own case page does not state that any already-separated servicemember was reinstated. Do not cite this entry for the proposition that separated members have been returned to duty; that remains unestablished.
