Summary

CMS issued QSSAM-25-02 to Medicare/Medicaid-participating hospitals and other covered entities, asserting that pediatric medical interventions for gender dysphoria were "initiated with an underdeveloped body of evidence" and "may cause long-term and irreparable harm," citing U.K./Swedish/Finnish restrictions, and warning that CMS "may begin taking steps in the future" to align its policies — an explicit signal of coming payment and participation conditions. Issued the day after the nationwide preliminary injunction in PFLAG v. Trump (D. Md., issued March 4, 2025), and five days after the four-state preliminary injunction in Washington v. Trump (W.D. Wash., issued February 28, 2025), both of which had already blocked direct enforcement of EO 14187's funding conditions.

Status

In effect as sub-regulatory guidance; operationalized by the May 2025 data demands and the December 2025 proposed rules. (See also sections 10, 13.)
