Summary

CMS sent letters to selected hospitals providing pediatric gender-affirming care, demanding within 30 days: informed-consent policies and protocols for minors with gender dysphoria; planned changes to clinical practice guidelines in light of the HHS review; evidence of adverse events including detransition-related harm; and complete financial data (billing codes, revenue since 2020, operating margins, forecasts) for federally paid pediatric procedures. CMS's newsroom framed the effort as an oversight initiative into hospitals performing "experimental sex trait modification procedures." The demands functioned as investigative discovery preceding the December 2025 rulemakings and August 2026 fraud referrals.

Status

Data collection completed/absorbed into subsequent enforcement; follow-on: December 2025 proposed rules and the August 13, 2026 coding report and DOJ/OIG referrals. (See also section 13.)
