Summary
Rescinds 29 CFR Part 37, the nondiscrimination and equal-opportunity regulations implementing section 188 of the repealed Workforce Investment Act of 1998, removing the entire part from the CFR. The Department proceeded by direct final rule with a concurrent request for comment, reasoning that WIA was superseded by WIOA in 2014, that all remaining WIA Title I grant funding has been closed out, and that the Part 37 regulations have been superseded by 29 CFR Part 38. The notice recites WIA § 188's protected bases (including sex) but does not discuss gender identity or transgender status. This is the opening move in the Civil Rights Center's WIOA-regime deregulatory sequence (RIN 1291-AA46); the same day the Department issued the affirmative-outreach proposal below.
Status
In effect. Effective September 2, 2025; effective date confirmed at 90 FR 41890 (Aug. 28, 2025). 29 CFR Part 37 no longer exists. No litigation identified.
