Summary

The appropriations law signed April 30, 2026, ending a 76-day partial DHS shutdown, provided no funding for OIDO and, per DHS, "significant cuts" to CRCL and the CIS Ombudsman "similar to the President's proposed budgets." Plaintiffs' response emphasized that the zero-funding outcome was precisely what DHS had requested in its own May 30, 2025 congressional justification, not an intervening congressional decision, and that § 503 of the Act (140 Stat. 773, 796–97) preserves substantial transfer and reprogramming flexibility.

Status

In effect. DHS treats it as authority to wind down OIDO; plaintiffs contend it cannot effect an implied repeal of 6 U.S.C. § 205. Unresolved in the pending litigation. (See also sections 9 and 11.)
