Summary

OCR concluded that CDE and CIF violate Title IX by following California Education Code § 221.5(f) (the 2013 statute guaranteeing participation consistent with gender identity), and issued a proposed resolution agreement - due by July 7, 2025 - requiring both to bar transgender girls from girls' sports and facilities, notify all districts that federal law "preempts" § 221.5, restore records to cisgender athletes, and send personalized apology letters. CDE and CIF formally rejected the agreement on July 7, 2025.

Status

Referred to DOJ, which sued July 9, 2025 (United States v. California Interscholastic Federation & CDE, C.D. Cal. No. 8:25-cv-01485; pending as of August 2026 - see sections 3 and 10). California's K-12 federal funding had not been terminated as of August 2026. Update, Sept. 23, 2026: On August 31, 2026, the court (Judge Cynthia Valenzuela) granted defendants' motion to dismiss and dismissed the complaint with prejudice and without leave to amend, terminating the case (C.D. Cal. No. 8:25-cv-01485, ECF 54); the government's Title IX enforcement suit against the California Interscholastic Federation and California Department of Education did not survive to a merits ruling on the underlying claims.
