Summary
One day after EO 14201 ("Keeping Men Out of Women's Sports," see section 1), OCR announced Title IX investigations into San Jose State University (2022-2024 women's volleyball roster spot for a transgender player), the University of Pennsylvania (Lia Thomas's 2021-22 swim season), and the Massachusetts Interscholastic Athletic Association (state policy permitting trans girls in girls' sports). All three concern conduct that was lawful under ED's own contemporaneous interpretation of Title IX when it occurred - the retroactivity point CSU later put at the center of its 2026 lawsuit.
Status
Penn resolved by agreement July 1, 2025; SJSU found in violation January 29, 2026 and CSU sued (both below); no public resolution of the MIAA investigation located as of August 2026.
