Summary
After the districts refused to sign resolution agreements by August 15, ED placed all five on "high-risk" status - converting more than $50 million in formula funds, discretionary grants, and impact aid to reimbursement-only with heightened compliance scrutiny - and announced administrative proceedings to suspend or terminate their federal financial assistance. Fairfax and Arlington sued (Fairfax County School Board v. McMahon, No. 1:25-cv-01432; Arlington School Board v. McMahon, No. 1:25-cv-01434, E.D. Va., filed Aug. 29, 2025); Judge Rossie Alston dismissed both in early September 2025 on Tucker Act jurisdictional grounds.
Status
High-risk conditions in place; Fourth Circuit appeals (Nos. 25-2087, 25-2107) argued January 29, 2026 before Judges Diaz, Richardson, and Rushing - decision still pending as of August 2026; administrative termination proceedings not publicly concluded. (See section 10.)
