Summary
OCR refused to certify NYC Public Schools' civil-rights compliance under the MSAP statute (20 U.S.C. § 7231d(c)) and simultaneously declined to continue NYC's five MSAP grants (~$11 million/year) - citing the district's transgender-inclusive policies as Title IX "civil rights violations" - with a three-business-day window to accept "remedial measures." Reconsideration was denied September 26; on September 29-30, 2025 ED issued revised grant award notifications resetting the project period to zero out FY2026, cutting off carryover funds three weeks into the school year.
Status
NYC sued October 15, 2025 (S.D.N.Y. No. 1:25-cv-08547); a November 20, 2025 consent order restored carryover-fund access; on April 8, 2026 the court granted summary judgment for NYC, vacating the non-continuation because ED bypassed Title IX's statutory notice, hearing, and congressional-reporting prerequisites for refusing funds; ED's appeal was withdrawn June 18, 2026.
