Summary

On and around January 31, 2025, CDC and other HHS components removed thousands of web pages and datasets referencing gender identity and transgender health — including HIV/STI guidance, the Youth Risk Behavior Survey materials, and LGBTQ+ youth health resources — to comply with OPM's implementation memo for EO 14168. Doctors for America sued (Doctors for America v. OPM, D.D.C. No. 1:25-cv-00322, filed Feb. 4, 2025), and Judge John Bates issued a TRO on February 11, 2025 ordering identified pages restored; many were reposted with disclaimers disparaging "gender ideology." (See section 12 for the full purge/terminology record.)

Status

Resolved on the merits: on July 3, 2025, Judge Bates granted summary judgment for plaintiffs in part, holding the OPM memo and HHS guidance arbitrary and capricious and vacating them, and ordering restoration of webpages to their January 29, 2025 status (2025 WL 1836009); the court held plaintiffs lacked standing to challenge the disclaimers agencies posted on restored pages. Defendants filed a series of compliance status reports — weekly from mid-July through late September 2025, then periodically — through a final report on December 12, 2025, and the court separately awarded $55,000 in attorney's fees (Oct. 1, 2025). Restored pages still carry EO 14168 disclaimers and some content remains altered or removed. (See also sections 10, 12.)
