Summary

Reporting on February 11, 2026 documents that the Pentagon is removing thousands of transgender troops under the gender-dysphoria disqualification policy implementing EO 14183, with military separation boards ordered to "find unfit and separate any transgender service member with a current or past documentation of gender dysphoria." Senior transgender officers, including Col. Bree Fram — the highest-ranking openly transgender officer — are among those forced out. The purge follows the Supreme Court's May 2025 stay permitting enforcement of the ban during litigation. (see also section 4)

Status

Accession bar remains enforceable; the D.C. Circuit affirmed a preliminary injunction in Talbott v. USA, No. 25-5087 (June 1, 2026), barring separation of currently serving transgender members (class certified June 30, 2026); Shilling remains before the Ninth Circuit. Update, Sept. 23, 2026: On Aug. 27, 2026, the government petitioned the Supreme Court for a writ of certiorari to review the D.C. Circuit's June 1, 2026 ruling in Talbott v. USA (docketed Sept. 1, 2026, as No. 26-272; response due Oct. 1, 2026). The D.C. Circuit case is now closed, and the injunction barring separation of currently-serving class members, and the accession bar, remain in effect pending the petition.
