Summary

Invoking the "unforeseen emergency refugee situation" provision, the determination finds an emergency arising from "recent increases in the incitement of racially motivated violence on the part of the Government of South Africa" and disruptions to USRAP operations there, concludes that Afrikaner admissions "cannot be accomplished under the refugee ceiling of 7,500," and raises the FY2026 ceiling to 17,500, directing that "[t]he additional admissions shall be allocated among Afrikaners from South Africa, consistent with the directives in Executive Order 14204." It further specifies, under INA § 101(a)(42)(B), that Afrikaners may be considered refugees "within their countries of nationality or habitual residence" — the only in-country processing designation for FY2026. The 10,000-slot increase is directed entirely to a single group defined by race and national origin, in a fiscal year in which no priority category, group designation, or referral authority reaching LGBTQI+ or transgender applicants remains in operation.
