FUNDING AND RESEARCH TERMINATIONS

Summary

Section 4 of EO 14187 ("Protecting Children From Chemical and Surgical Mutilation") directs agencies that provide research or education grants to medical institutions, including hospitals and medical schools, to "end" gender-affirming medical interventions for people under 19, conditioning federal grant funding on institutions ceasing such care. Together with EO 14168's directive that federal funds not "promote gender ideology," it became the legal basis agencies cited for grant terminations and new award conditions across HHS, NIH, HRSA, and NSF. (See also sections 1, 2, 13.)

Status

Funding-condition provisions of EOs 14168/14187 preliminarily enjoined in PFLAG v. Trump, No. 8:25-cv-00337 (D. Md.) and Washington v. Trump (W.D. Wash.). In PFLAG, the Fourth Circuit denied the government's motion for stay pending appeal (order noted on district docket April 16, 2026) and denied rehearing en banc (May 21, 2026); that interlocutory appeal remains pending. Washington v. Trump's appeal remains before the Ninth Circuit (No. 25-1922), argued March 5, 2026, with no decision issued. Agencies continued pursuing the same objective through CMS letters and December 2025 proposed rules (below).
