Summary

EO 14173 ("Ending Illegal Discrimination and Restoring Merit-Based Opportunity") revoked EO 11246, which since 2014 amendments had barred federal contractors from discriminating based on sexual orientation and gender identity. On January 24, 2025, Acting Labor Secretary Vincent Micone issued Secretary's Order 03-2025 directing all DOL staff, including OFCCP, to cease "all pending cases, conciliation agreements, investigations, complaints, and any other enforcement-related or investigative activity" under EO 11246. Contractors were given a 90-day wind-down through approximately April 21, 2025. This eliminated the principal administrative enforcement mechanism against anti-transgender discrimination by federal contractors. (See also section 1.)

Status
