Summary
In July 2026, BOP transferred four transgender women protected by the June 7 injunction from general population at FMC Carswell (Fort Worth) into a restrictive segregated unit with "little or no access to recreation, work, or programming," and notified the court on July 15, 2026 of plans to move additional plaintiffs there. Plaintiffs moved to enforce the injunction, arguing the unit is a men's-prison regime in a women's facility that circumvents the housing order while implementing EO 14168, and constitutes cruel and unusual punishment; the government answered that the transfers comply with the injunction's literal terms, invoking the Fleming separate-housing injunction. Judge Lamberth heard the enforcement and intervention motions on July 29, 2026 without ruling from the bench.
Status
The district court denied the Doe plaintiffs' enforcement/injunctive-relief motion regarding the segregated unit on August 12, 2026; plaintiffs moved August 18, 2026 for a new preliminary injunction, which remained pending as of August 20, 2026, and the segregated-unit placements remain in place.
