Summary
OCR sent the district a February 25, 2026 letter terminating its 2016 OCR resolution agreement, which had required the district to permit students to use facilities consistent with gender identity, and directing rollback of the associated protections. In late March 2026 the school board voted unanimously to remove "gender identity" and "gender expression" as protected categories from its nondiscrimination policy; officials warned the district could lose federal funding otherwise, notwithstanding Pennsylvania regulations protecting transgender students. Community members walked out of the meeting. The Education Department terminated similar agreements with at least four other districts (including Delaware's Cape Henlopen School District) and one college.
