Summary

On remand, Judge Lamberth on June 7, 2026 entered a new preliminary injunction with the individualized findings the D.C. Circuit required, concluding each of the 14 consolidated plaintiffs faces "increased risk of violence" and severe exacerbation of gender dysphoria if moved to a men's facility, and ordering that they be housed in women's prisons or women's halfway houses. The court simultaneously stayed plaintiffs' § 4(c) medical claims pending Kingdom (May 21, 2026 order) and held its injunction did not conflict with a June 2, 2026 injunction obtained by cisgender women prisoners in Fleming v. Warden T. Rule (N.D. Tex. 4:25-cv-00157), which requires transgender women at FMC Carswell to be housed and scheduled separately from other women — because the D.C. injunction only bars transfer to men's prisons.

Status

In effect; government appeal filed June 22, 2026 (No. 26-5238); enforcement proceedings ongoing over FMC Carswell segregation (below).
