Summary

Simultaneously with the Medicaid final rule, HHS released a report ("HHS Releases Report Exposing Fraudulent Insurance Coding for Sex-Rejecting Procedures on Minors") identifying 225 hospitals with pediatric gender programs and flagging roughly $50 million in allegedly questionable insurance claims — asserting providers miscoded gender-affirming services (e.g., as endocrine or precocious-puberty care) to obtain payment — and referred scores of health systems, pediatric hospitals, physician groups, specialty pharmacies, and pharmacy benefit managers to DOJ and the HHS OIG for investigation of past billing. The report converts prior "oversight" data collection into a fraud-enforcement predicate against providers nationwide. (See also sections 3, 13.)

Status

Referrals announced August 13, 2026; OIG review underway per trade press; no charges or False Claims Act complaints identified as of August 20, 2026.
