Secretary Noem approves the reduction in force eliminating all GS positions at all three oversight offices
- Date
- Actor
- Secretary of Homeland Security Kristi Noem
- Agency
- Department of Homeland Security (DHS)
- Type
- Personnel action
Summary
A March 17, 2025 Memorandum for the Secretary asked Noem to approve a RIF affecting "all employees" of CRCL, OIDO, and CISOM other than deferred-resignation participants, and informed her the action would reach 147 GS employees at CRCL, 117 at OIDO, and 45 at CISOM. The stated basis was Executive Order 14210 (DOGE Workforce Optimization Initiative) and the February 26, 2025 OMB/OPM guidance on Agency RIF and Reorganization Plans. The accompanying statutory-authorities memorandum expressly told the Secretary that CRCL is required by statute to assess and investigate complaints of civil-rights and civil-liberties abuses by DHS employees. Noem signed the approval on March 20, 2025. In discovery, DHS was unable to locate any documents showing it notified or consulted Congress about the reorganization on or before March 21, 2025, as 6 U.S.C. § 452 requires.
Status
Executed; legality contested in Kennedy Human Rights Center v. DHS (see section 10). Plaintiffs argue the action violated Homeland Security Act § 872 (6 U.S.C. § 452(b)(1)), which bars abolition of any unit or function required to be maintained by statute.
