Summary

USCIS updates its Policy Manual, effective immediately and applicable to all pending and future benefit requests, to state that USCIS recognizes only two biological sexes, male and female; determines sex from the birth certificate issued at or nearest the time of birth (with secondary evidence where that certificate shows other than M/F); removes the "X" marker from all USCIS forms and documents (green cards, EADs, naturalization certificates); and replaces "gender" with "sex" throughout. USCIS states it may issue documents bearing a sex different from the one the requestor selected, with delays possible for mismatched filings. (See also section 7.)
