Summary

A February 5, 2025 internal directive ordered review of Department grants for "DEI" practices; two days later the Department began sending identical boilerplate termination letters cancelling 104 of 109 grants under the Teacher Quality Partnership and Supporting Effective Educator Development programs (about $65 million remained undrawn), asserting the grants funded "DEI initiatives... that unlawfully discriminate." Eight states sued (California v. U.S. Department of Education, D. Mass.); the district court's March 10, 2025 TRO ordered the grants restored. On April 4, 2025, the Supreme Court (per curiam; Roberts, Kagan, Jackson and Sotomayor dissenting) stayed the order, reasoning the government would likely show the district court lacked APA jurisdiction because the Tucker Act channels such claims to the Court of Federal Claims — the jurisdictional theory later applied against NIH grantees in NIH v. APHA. The gender-content review criteria driving this purge are covered in section 5. (See also sections 5, 10.)
