Summary

Guide Notice NOT-OD-25-090 (April 21, 2025) added a civil-rights term to all new and continuing domestic awards requiring recipients to certify they do not operate DEI programs deemed to violate federal anti-discrimination law — with "discriminatory equity ideology" defined by reference to EO 14190, whose definition encompasses gender-identity-related concepts — and do not boycott Israel, with NIH reserving the right to terminate awards and claw back funds for violations. NIH simultaneously stripped diversity-recruitment and diversity-plan requirements from applications and training grants.

Status

NOT-OD-25-090 was rescinded June 12, 2025 and replaced by NOT-OD-25-124; certification-style award terms persisted in successor form. The APHA court's vacatur covered the research-priority directives rather than these award terms.
