Summary

Acting on a complaint filed February 3, 2025 by America First Legal, OCR opened investigations into Alexandria City, Arlington County, Fairfax County, Loudoun County, and Prince William County public schools over policies allowing students to use restrooms and locker rooms matching their gender identity (e.g., Loudoun's Policy 8040), which the districts had adopted in part to comply with Virginia law and Fourth Circuit precedent (Grimm v. Gloucester).

Status

Violation findings issued July 25, 2025; districts refused the resolution agreement; high-risk funding status and termination proceedings followed (below).
