Summary
ACF issued an NPRM (91 FR, doc. 2026-04515) to rescind the April 30, 2024 final rule requiring title IV-E/IV-B child-welfare agencies to ensure "designated placements" — foster placements trained and committed to supporting LGBTQI+ (including transgender) youth — and to protect such youth from retaliation. The E.D. Texas had already vacated the 2024 rule (final judgment June 13, 2025, following a March 13, 2025 ruling that HHS lacked rulemaking authority); the NPRM proposed removing the regulatory text entirely.
