Summary
One day after Jeffco requested continued negotiations, OCR declared impasse and publicly announced a "warning letter" (June 3, 2026 press release), demanding execution of the resolution agreement by June 15 - one day before a scheduled negotiation meeting OCR then skipped. On June 26, 2026, OCR issued a Letter of Impending Enforcement Action (announced as "tak[ing] action against Jefferson County Public Schools for continued violations of Title IX"), placing Jeffco's more than $50 million in annual federal funding at risk of administrative termination and DOJ referral.
Status
Jeffco sued ED and Secretary McMahon on July 28, 2026 (D. Colo. No. 1:26-cv-03427, Judge Robert E. Blackburn), asserting APA and constitutional claims and noting that the Supreme Court's June 30, 2026 decision in West Virginia v. B.P.J. left open whether Title IX permits inclusive policies; defendants' answers due October 13, 2026; funding not yet terminated. (See section 10.)
