Summary
DHS published a 60-day notice seeking OMB clearance for a "reinstatement without change of a currently approved collection" — the DHS Civil Rights and Civil Liberties Complaint and Privacy Waiver Form. The notice's description of the complaints CRCL investigates lists discrimination based on "race, ethnicity, national origin, religion, sex, sexual orientation, sex, or disability." The corresponding August 23, 2021 notice for the same collection listed discrimination based on "race, ethnicity, national origin, religion, sex, sexual orientation, gender identity, or disability." The 2026 text substitutes a second, duplicative "sex" in the exact slot previously occupied by "gender identity," conforming CRCL's public description of its own complaint jurisdiction to EO 14168's terminology mandate. The notice estimates 13,000 respondents and 6,500 annual burden hours — against the two full-time investigators and contractor staff who make up the rebuilt office. Comments close September 21, 2026.
Status
Open for comment; the collection is characterized as a reinstatement, indicating the prior OMB clearance had lapsed. No public DHS statement identified explaining the change in enumerated bases. (See also sections 1 and 12.)
