Summary
CMS publishes "Medicaid Program; Prohibition on Federal Medicaid and Children's Health Insurance Program Funding for Sex-Rejecting Procedures Furnished to Children" (doc. 2026-16508). The rule bars federal Medicaid matching funds for puberty blockers, cross-sex hormone therapy, and gender-transition surgery for beneficiaries under 18, and bars federal CHIP funding for enrollees under 19 (reaching 18-year-old legal adults in CHIP). States may continue coverage only with state-only dollars. Exceptions preserve care for disorders of sexual development, other medically accepted indications (e.g., precocious puberty), complication management, and mental-health treatment; a six-month tapering period runs from the effective date for those already on hormone therapy (the rule describes the period as six months rather than stating a calendar end date). Effective October 13, 2026, per the rule's own DATES section. (see also sections 2, 9)
Status
Final; effective October 13, 2026. GLAD Law and other groups state the rule "will face legal challenge"; no suit yet filed as of August 20, 2026 (searches of CourtListener/RECAP for dockets filed on or after August 11, 2026 returned none — but the rule was eight days old at the cutoff and RECAP lags on new dockets, so treat this as no evidence found, not proof of absence). Verified detail. Codified at new 42 CFR part 441 subpart N (§§ 441.800–441.802) and 42 CFR 457.476. CMS rests the rule on general Medicaid authority — SSA §§ 1902(a)(19) and 1902(a)(30)(A), §§ 2101(a) and 2107(e) for CHIP, and § 1102 — and disclaims reliance on the Kennedy Declaration and on the enjoined sections of prior executive orders, while affirmatively invoking section 5(a) of Executive Order 14187 as an additional basis (the preamble states the rule "is based on independent legal authority and section 5(a) of E.O. 14187"). That matters for reversal: because no statute compels the prohibition, it can be undone entirely by rulemaking, with no legislative obstacle. OIRA review ran June 16 to August 10, 2026. Two internal contradictions worth noting for citation: CMS states at 91 FR 52423 that this is a "major rule" triggering the CRA's 60-day delay, while OIRA's machine-readable record lists it as not major and not economically significant; and the preamble reports "approximately 11,000 timely pieces of correspondence" while the Federal Register API reports 34,960 comments on the NPRM.
