Summary
In February 2025, ICE removed from its website the 2015 "Further Guidance Regarding the Care of Transgender Detainees" memorandum — issued in 2015 under then-ERO official Tom Homan — which had prohibited discrimination or harassment based on gender identity and provided for individualized placement (including possible placement consistent with gender identity), search protocols, clothing and hygiene accommodations, pronoun use, and access to transgender-related health care including hormone therapy. No replacement guidance was issued; the removal left transgender ICE detainees governed only by generic standards pending the 2025 standards revision below.
Status
Memorandum rescinded/vacated from ICE policy; superseded in practice by the 2025 National Detention Standards, which contain no transgender provisions.
