Summary
On February 12, 2026 the D.D.C. grants a preliminary injunction in Jones v. Trump against enforcement of EO 14168 provisions challenged by transgender plaintiffs in federal custody, and the same day extends the class preliminary injunction in Kingdom v. Trump, which protects transgender people in Bureau of Prisons custody from transfer to facilities by birth sex and from termination of gender-affirming care. The government appeals Jones to the D.C. Circuit on February 23, 2026. A protective order for the Kingdom plaintiffs also issued in February 2026. (see also sections 7, 10)
Status
Jones appeal pending at D.C. Circuit; Kingdom injunction extended, later partially stayed by the D.C. Circuit (June 2026) with a separate district-court injunction still blocking BOP actions. Update, Sept. 23, 2026: As to the Kingdom injunction specifically (this entry also covers the separate Jones v. Trump appeal, which is unaffected): On Sept. 18, 2026, a per curiam D.C. Circuit panel (Wilkins, Walker, and Garcia, JJ.) dismissed as moot the government's motion to stay the district court's since-expired June 17, 2026 injunction and denied its motion to stay the district court's (Lamberth, J.) August 26, 2026 reissued injunction against BOP Program Statement 5260.01 (D.C. Cir. Nos. 26-5236 and 26-5310, consolidated), holding the government had not shown a likelihood of success on its arguments that the policy was arbitrary and capricious, that the injunction violated the PLRA, or that classwide relief was improper (Walker, J., dissenting); the clerk was directed to set a merits briefing schedule, and the reissued injunction remains in effect.
