Summary

CMS publishes the proposed 2027 Notice of Benefit and Payment Parameters (doc. 2026-02769; comments closed March 13, 2026), the annual ACA-marketplace rule whose text carries forward the administration's "sex-trait modification" framework after the Marketplace Integrity and Affordability final rule (doc. 2025-11606, finalized June 25, 2025) -- not the 2026 NBPP itself, which HHS finalized January 15, 2025 (doc. 2025-00640), before the change in administration -- prohibited coverage of gender-affirming care as an essential health benefit beginning plan year 2026. The 2027 parameters were finalized May 20, 2026 (doc. 2026-10050), effective July 20, 2026. (see also section 2)

Status

Final rule effective July 20, 2026; the EHB exclusion of gender-affirming care remains in force for ACA marketplace plans.
