URGING THE UNITED STATES CONGRESS TO PASS A PROPOSED AMENDMENT
8
TO THE CONSTITUTION OF THE UNITED STATES DEFINING MARRIAGE AS
9
A LEGAL UNION BETWEEN ONE MAN AND ONE WOMAN.
10
WHEREAS, a traditional marriage between a man and a
11
woman is the God-ordained building block of the family and the
12
bedrock of a civil society; and
13
WHEREAS, in 1996, President Clinton signed the
14
Defense of Marriage Act, which denied federal recognition of
15
same-sex marriages and allowed states to ignore those unions
16
licensed elsewhere; and
17
WHEREAS, Alabama law currently provides that
18
marriage is inherently a unique relationship between a man and
19
a woman; and
20
WHEREAS, because of the "full faith and credit"
21
clause in the U.S. Constitution, every other state may be
22
forced to accept the legalization of homosexual marriage by
23
another state; and
24
WHEREAS, legislation was filed in the 108th Congress
25
of the United States, House Joint Resolution 56, proposing an
26
amendment to the Constitution of the United States to provide
27
Page 2
that marriage shall consist only of the union of a man and a
1
woman and to prohibit the U.S. Constitution, the constitution
2
of any state, or any state or federal law to be construed to
3
require that marital status or the legal incidents thereof be
4
conferred on unmarried couples or groups; and
5
WHEREAS, the proposed constitutional amendment filed
6
in the 108th Congress or one substantially similar to it would
7
constitutionally guarantee what is explicitly provided for in
8
the United States Code as a result of the passage of the
9
Defense of Marriage Act in 1996; now therefore,
10
BE IT RESOLVED BY THE LEGISLATURE OF ALABAMA, BOTH
11
HOUSES THEREOF CONCURRING, That the Congress of the United
12
States is urged to enact a proposed amendment to the
13
Constitution of the United States to provide that marriage
14
shall consist only of the union of a man and a woman and to
15
prohibit the U.S. Constitution, the constitution of any state,
16
or any state or federal law to be construed to require that
17
marital status or the legal incidents thereof be conferred on
18
unmarried couples or groups.
19
BE IT FURTHER RESOLVED, That a copy of this
20
resolution be provided to the President of the United States,
21
to the Speaker of the House of Representatives and the
22
President of the Senate of the United States Congress, and to
23
each member of the Alabama Delegation to Congress.
