CALIFORNIA LEGISLATURE—
2007–2008 REGULAR SESSION
Senate Bill
No. 1600
Introduced by
Senator
Kuehl
February 22, 2008
An act to amend Section 51931 of the Education Code, relating to school curriculum.
LEGISLATIVE COUNSEL'S DIGEST
SB 1600, as introduced, Kuehl.
School curriculum: sexual health education and HIV/AIDS prevention education.
The California Comprehensive Sexual Health and HIV/AIDS Prevention Education Act authorizes school districts to provide comprehensive sexual health education, consisting of age-appropriate instruction, in kindergarten or any of grades 1 to 12, inclusive. The act requires school districts to ensure that all pupils in grades 7 to 12, inclusive, receive HIV/AIDS prevention education at least once in junior high or middle school and at least once in high school. The act requires school districts to cooperatively plan and conduct in-service training for all school district personnel who provide HIV/AIDS prevention education, through regional planning, joint powers agreements, or contract services. The act requires school districts to send a specified notice regarding instruction in comprehensive sexual health education and HIV/AIDS prevention education to the parent or guardian of each pupil at the beginning of each school year. The act defines a “school district” for
purposes of its provisions as including county boards of education, county superintendents of schools, the California School for the Deaf, and the California School for the Blind.
This bill, in addition, would provide that the definition of a “school district” for purposes of the act includes charter schools.
By requiring charter schools to perform additional duties by providing HIV/AIDS prevention education and related in-service training and sending notices to the parents and guardians of pupils, this bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates
determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.
