Second Regular Session Seventy-second General Assembly STATE OF COLORADO INTRODUCED LLS NO. 20-1324.01 Conrad Imel x2313 SENATE BILL 20-221 Senate Committees House Committees State, Veterans, & Military Affairs A BILL FOR AN ACT CONCERNING BANNING THE USE OF A PANIC DEFENSE UNLESS A PARTY 101 CAN SHOW ITS RELEVANCE TO THE COURT. 102 Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. If this bill passes third reading in the house of introduction, a bill summary that applies to the reengrossed version of this bill will be available at http://leg.colorado.gov.) The bill states that generally evidence relating to the discovery of, knowledge about, or potential disclosure of the victim's actual or perceived gender, gender identity, gender expression, or sexual orientation, including under circumstances in which the victim made an unwanted nonforcible romantic or sexual advance toward the defendant or if the defendant and victim are or have been involved in an intimate SENATE SPONSORSHIP Moreno and Tate, HOUSE SPONSORSHIP Titone and Soper, Shading denotes HOUSE amendment. Double underlining denotes SENATE amendment. Capital letters or bold & italic numbers indicate new material to be added to existing statute. Dashes through the words indicate deletions from existing statute. relationship, is irrelevant in a criminal case and does not constitute sudden heat of passion in a criminal case. The bill creates a protective hearing if a party claims that such evidence is relevant and wants to use it in a criminal case. Be it enacted by the General Assembly of the State of Colorado: 1 SECTION 1. Legislative declaration. The general assembly 2 hereby finds and declares that it is the right of every crime victim to be 3 protected from bias-motivated crimes, including crimes against lesbian, 4 gay, bisexual, transgender, and queer persons. The general assembly 5 further finds and declares that it is the right of every victim and witness 6 to be treated with respect and protected from unfair attack on their 7 character and privacy. So-called "gay panic" and "trans panic" defenses 8 seek to partially or completely excuse a defendant from full accountability 9 for the commission of a violent crime on the grounds that the sexual 10 orientation or gender identity or expression of the victim is sufficient in 11 itself to arouse the heat of passion in the defendant, or contribute to a 12 valid provocation or justification for the violent reaction of the defendant, 13 or cause the defendant to be temporarily insane. In other contexts, a 14 victim's or witness's gender identity or expression or sexual orientation is 15 used to attack their credibility and character and invade their privacy, 16 creating disincentives to testify and impediments to the search for truth 17 and justice. These tactics appeal to irrational fears and hatred of these 18 persons, undermining the legitimacy of criminal prosecutions and 19 resulting in unjustifiable acquittals or sentencing reductions due to bias, 20 fear, shock, or disgust rather than competent evidence. Continued use of 21 these anachronistic defenses and appeals to reinforce bias and 22 institutionalize prejudice at the expense of norms of self-control, 23 SB20-221 -2- tolerance, and compassion, which the law should encourage, and it is an 1 impediment to a just criminal justice system. Any suggestion of legally 2 sanctioned discrimination against a person's sexual orientation or gender 3 identity or expression must end. As the American Bar Association has 4 urged legislative action to curtail the availability and effectiveness of "gay 5 panic" and "trans panic" defenses, the general assembly brings forth this 6 legislation. 7 SECTION 2. In Colorado Revised Statutes, 16-8-101.5, amend 8 (2) as follows: 9 16-8-101.5. Insanity defined - offenses committed on and after 10 July 1, 1995 - definitions. (2) As used in subsection (1) of this section: 11 (a) "Diseased or defective in mind" does not refer to an 12 abnormality manifested only by repeated criminal or otherwise antisocial 13 conduct. EVIDENCE OF KNOWLEDGE OR AWARENESS OF THE VICTIM'S 14 ACTUAL OR PERCEIVED GENDER, GENDER IDENTITY, GENDER EXPRESSION, 15 OR SEXUAL ORIENTATION SHALL NOT CONSTITUTE INABILITY TO 16 DISTINGUISH RIGHT FROM WRONG. 17 (b) "GENDER IDENTITY" AND "GENDER EXPRESSION" HAVE THE 18 SAME MEANING AS IN SECTION 18-1-901 (3)(h.5). 19 (b) (c) "Mental disease or defect" includes only those severely 20 abnormal mental conditions that grossly and demonstrably impair a 21 person's perception or understanding of reality and that are not 22 attributable to the voluntary ingestion of alcohol or any other 23 psychoactive substance but does not include an abnormality manifested 24 only by repeated criminal or otherwise antisocial conduct. 25 (d) "SEXUAL ORIENTATION" HAS THE SAME MEANING AS IN 26 SECTION 18-9-121 (5)(b). 27 SB20-221 -3- SECTION 3. (3) Notwithstanding the provisions of subsection (1) of this 4 section, a person is not justified in using physical force if: 5 (b) He OR SHE is the initial aggressor; except that his OR HER use 6 of physical force upon another person under the circumstances is 7 justifiable if he OR SHE withdraws from the encounter and effectively 8 communicates to the other person his OR HER intent to do so, but the latter 9 nevertheless continues or threatens the use of unlawful physical force; or 10 (c) The physical force involved is the product of a combat by 11 agreement not specifically authorized by law; OR 12 (d) THE USE OF PHYSICAL FORCE AGAINST ANOTHER IS BASED ON 13 THE DISCOVERY OF, KNOWLEDGE ABOUT, OR POTENTIAL DISCLOSURE OF 14 THE VICTIM'S ACTUAL OR PERCEIVED GENDER, GENDER IDENTITY, GENDER 15 EXPRESSION, OR SEXUAL ORIENTATION, INCLUDING BUT NOT LIMITED TO 16 UNDER CIRCUMSTANCES IN WHICH THE VICTIM MADE AN UNWANTED 17 NONFORCIBLE ROMANTIC OR SEXUAL ADVANCE TOWARD THE DEFENDANT. 18 NOTHING IN THIS SUBSECTION (3)(d) PRECLUDES THE ADMISSION OF 19 EVIDENCE, WHICH IS OTHERWISE ADMISSIBLE, OF A VICTIM'S OR WITNESS'S 20 CONDUCT, BEHAVIOR, OR STATEMENTS. 21 (5) AS USED IN THIS SECTION, UNLESS THE CONTEXT OTHERWISE 22 REQUIRES: 23 (a) "GENDER IDENTITY" AND "GENDER EXPRESSION" HAVE THE 24 SAME MEANING AS IN SECTION 18-1-901 (3)(h.5). 25 (b) "INTIMATE RELATIONSHIP" HAS THE SAME MEANING AS IN 26 SECTION 18-6-800.3. 27 SB20-221 -4- (c) "SEXUAL ORIENTATION" HAS THE SAME MEANING AS IN 1 SECTION 18-9-121 (5)(b). 2 SECTION 4.
