RELATING TO EDUCATION; AMENDING SECTION 33-1611, IDAHO CODE, TO PROHIBIT IN-

STRUCTION ON HUMAN SEXUALITY, SEXUAL ORIENTATION, AND GENDER IDENTITY

PRIOR TO FIFTH GRADE AND TO MAKE A TECHNICAL CORRECTION; AND DECLARING
4
AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.

Be It Enacted by the Legislature of the State of Idaho:

SECTION 1. That Section 33-1611, Idaho Code, be, and the same is hereby
7
amended to read as follows:

33-1611.
EXCUSING CHILDREN FROM INSTRUCTION IN SEX EDUCATION -- IN-
9
STRUCTION TO BEGIN AT APPROPRIATE AGE. (1) Any parent or legal guardian who
10
wishes to have his child excused from any planned instruction in sex edu-
11
cation may do so upon filing a written request to the school district board
12
of trustees, and the board of trustees shall make available the appropriate
13
forms for such request. Alternative educational endeavors shall be provided
14
for those excused.

(2)
Planned instruction by school personnel or third parties on human
16
sexuality, sexual orientation, or gender identity shall not occur prior to
17
grade 5.

SECTION 2.
An emergency existing therefor, which emergency is hereby
19
declared to exist, this act shall be in full force and effect on and after
20
July 1, 2024.
