EXPLANATION – Matter in bolded italics is new; matter between brackets [omitted material] is material to be omitted.
AN ACT relating to discrimination; amending various provisions of
existing law to prohibit discrimination on the basis of
sexual orientation and gender identity or expression; and
providing other matters properly relating thereto.
Legislative Counsel’s Digest:
This bill adds “gender identity or expression” and “sexual orientation” to
1
various provisions of existing law that prohibit discrimination, thus expanding the
2
bases upon which discrimination is impermissible. Section 13 of this bill
3
specifically adds “gender identity or expression” to the list of attributes upon which
4
the murder of a person in the first degree may be aggravated.
5
Sections 5 and 6 of this bill define the terms “gender identity or expression”
6
and “sexual orientation” for use throughout the entirety of the Nevada Revised
7
Statutes (NRS). Sections 1, 7, 12, 14, 18, 23, 29, 34-36, 38 and 40 of this bill
8
delete definitions for those terms from existing sections of NRS, without changing
9
their meanings, to avoid repeating the definitions in multiple locations.

Sec. 41. NRS 686A.680 is hereby amended to read as follows:
8
686A.680 An insurer that uses information from a consumer
9
credit report shall not:
10
1. Use an insurance score that is calculated using income,
11
gender, sexual orientation, gender identity or expression, address,
12
zip code, ethnic group, religion, marital status or nationality of the
13
consumer as a factor, or would otherwise lead to unfair or invidious
14
discrimination.
15
2. Deny, cancel or fail to renew a policy on the basis of credit
16
information unless the insurer also considers other applicable
17
underwriting factors that are independent of credit information and
18
not expressly prohibited by this section.
19
3. Base renewal rates for a policy upon credit information
20
unless the insurer also considers other applicable factors
21
independent of credit information.
22
4. Take an adverse action against an applicant or policyholder
23
based on the applicant or policyholder not having a credit card
24
account unless the insurer also considers other applicable factors
25
independent of credit information.
26
5. Consider an absence of credit information or an inability to
27
calculate an insurance score in underwriting or rating a policy unless
28
the insurer does any one of the following:
29
(a) Treats the applicant or policyholder as otherwise approved
30
by the Commissioner, after the insurer presents to the Commissioner
31
information indicating that such an absence or inability relates to the
32
risk for the insurer.
33
(b) Treats the applicant or policyholder as if the applicant or
34
policyholder had neutral credit information, as defined by the
35
insurer.
36
(c) Excludes the use of credit information as a factor, and uses
37
only underwriting criteria other than credit information.
38
6. Take an adverse action against an applicant or policyholder
39
based on credit information, unless an insurer obtains and uses a
40
consumer credit report issued or an insurance score calculated
41
within 90 days from the date the policy is first written or renewal is
42
issued.
43
7. Except as otherwise provided in this subsection, use credit
44
information regarding a policyholder without obtaining an updated
45
– 34 –
-
*SB164*
consumer credit report regarding the policyholder and recalculating
1
the insurance score at least once every 36 months. At the time of the
2
annual renewal of a policyholder’s policy, the insurer shall, upon the
3
request of the policyholder or the policyholder’s agent, reunderwrite
4
and rerate the policy based upon a current consumer credit report or
5
insurance score. An insurer need not, at the request of a policyholder
6
or the policyholder’s agent, recalculate the insurance score of or
7
obtain an updated consumer credit report of the policyholder more
8
frequently than once in any 12-month period. An insurer may, at its
9
discretion, obtain an updated consumer credit report regarding a
10
policyholder more frequently than once every 36 months, if to do so
11
is consistent with the underwriting guidelines of the insurer. An
12
insurer does not need to obtain an updated consumer credit report
13
for a policyholder if any one of the following applies:
14
(a) The insurer is treating the policyholder as otherwise
15
approved by the Commissioner.
16
(b) The policyholder is in the most favorably-priced tier of the
17
insurer and all affiliates of the insurer. With respect to such a
18
policyholder, the insurer may elect to obtain an updated consumer
19
credit report if to do so is consistent with the underwriting
20
guidelines of the insurer.
21
(c) Credit information was not used for underwriting or rating
22
the policyholder when the policy was initially written. The fact that
23
credit information was not used initially does not preclude an
24
insurer
from
using
such
information
subsequently
when
25
underwriting or rating such a policyholder upon renewal, if to do so
26
is consistent with the underwriting guidelines of the insurer.
27
(d) The insurer reevaluates the policyholder at least once every
28
36 months based upon underwriting or rating factors other than
29
credit information.
30
8. Use the following as a negative factor in any insurance
31
scoring methodology or in reviewing credit information for the
32
purpose of underwriting or rating a policy:
33
(a) Credit inquiries not initiated by the applicant or policyholder,
34
or inquiries requested by the applicant or policyholder for his or her
35
own credit information.
36
(b) Inquiries relating to insurance coverage, if so identified on
37
the consumer credit report.
38
(c) Collection accounts relating to medical treatment, if so
39
identified on the consumer credit report.
40
(d) Multiple lender inquiries, if identified on the consumer credit
41
report as being related to home loans or mortgages and made within
42
30 days of one another, unless only one inquiry is considered.
43
– 35 –
-
*SB164*
(e) Multiple lender inquiries, if identified on the consumer credit
1
report as being related to a loan for an automobile and made within
2
30 days of one another, unless only one inquiry is considered.
3
Sec. 42. NRS 686B.060 is hereby amended to read as follows:
4
686B.060 In determining whether rates comply with the
5
standards under NRS 686B.050, the following criteria shall be
6
applied:
7
1. Due consideration shall be given to past and prospective loss
8
and expense experience within and outside of this state, to
9
catastrophe hazards and contingencies, to trends within and outside
10
of this state, to loadings for leveling premium rates over time or for
11
dividends or savings to be allowed or returned by insurers to their
12
policyholders, members or subscribers, and to all other relevant
13
factors, including the judgment of technical personnel.
14
2. Risks may be classified in any reasonable way for the
15
establishment of rates and minimum premiums, except that
16
classifications may not be based on race, color, creed , [or] national
17
origin [.] , sexual orientation, or gender identity or expression.
18
Rates thus produced may be modified for individual risks in
19
accordance with rating plans or schedules which establish
20
reasonable standards for measuring probable variations in hazards,
21
expenses, or both.
22
3. The expense provisions included in the rates to be used by
23
an insurer may reflect the operating methods of the insurer and, so
24
far as it is credible, its own expense experience.
25
4. The rates may contain an allowance permitting a profit that
26
is not unreasonable in relation to the riskiness of the class of
27
business.
28
Sec. 43. NRS 687B.390 is hereby amended to read as follows:
29
687B.390 No insurer shall cancel or refuse to renew an

automobile liability insurance policy solely because of the age,
31
residence, race, color, creed, national origin, ancestry , sexual
32
orientation, gender identity or expression or occupation of anyone
33
who is an insured.
34
Sec. 44. NRS 689C.520 is hereby amended to read as follows:

36
registration, each voluntary purchasing group shall, to the

44
– 36 –
-
*SB164*

1
incurred in administering the group.
2
(b) Provide to members of the group and their eligible
3
employees information meeting the requirements of NRS 689C.440
4
regarding any proposed contracts.
5
2. In addition to the information required pursuant to
6
subsection 1, a voluntary purchasing group shall provide annually to
7
members of the group information regarding available benefits and
