State of South Dakota NINETY-FOURTH SESSION LEGISLATIVE ASSEMBLY, 2019 767B0769 HOUSE BILL NO. 1225 Introduced by: Representatives Qualm, Beal, Goodwin, Hansen, and Mulally and Senators Greenfield (Brock), Klumb, and Stalzer FOR AN ACT ENTITLED, An Act to establish a determinant in identifying a student's sexual 1 identity for the purpose of participation in high school athletics. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. That the code be amended by adding a NEW SECTION to read: 4 For purposes of participation in athletics sanctioned by the South Dakota High School 5 Activities Association, the sole determinant of a student's sexual identity is the sexual identity 6 noted on the student's certificate of birth. If no sexual identity is noted on the student's certificate 7 of birth, the sole determinant is the sexual identity noted on the South Dakota High School 8 Activities Association Physical Exam Form that is completed by a health care professional at 9 the student's physical examination. 10 100 copies were printed on recycled paper by the South Dakota Legislative Research Council at a cost of $.167 per page. v Insertions into existing statutes are indicated by underscores.
