SB1216 001946 -1- HOUSE BILL 490 By Jones SENATE BILL 1216 By Ford AN ACT to amend Tennessee Code Annotated, Title 4, Chapter 21; Title 8 and Title 50, relative to discrimination based on sexual orientation and gender identity or expression. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: SECTION 1. Tennessee Code Annotated, Section 4-21-401, is amended by deleting the language "age or national origin" wherever it appears and by substituting instead the language "sexual orientation, gender identity or expression, age, or national origin". SECTION 2. Tennessee Code Annotated, Section 4-21-402, is amended by deleting the language "age or national origin" wherever it appears and by substituting instead the language "sexual orientation, gender identity or expression, age, or national origin". SECTION 3. Tennessee Code Annotated, Section 4-21-403, is amended by deleting the language "age or national origin" and by substituting instead the language "sexual orientation, gender identity or expression, age, or national origin". SECTION 4. Tennessee Code Annotated, Section 4-21-404, is amended by deleting the language "or national origin" wherever it appears and by substituting instead the language "sexual orientation, gender identity or expression, or national origin". SECTION 5. Tennessee Code Annotated, Section 4-21-406(b), is amended by deleting the language "age or national origin" and by substituting instead the language "sexual orientation, gender identity or expression, age, or national origin". SECTION 6. Tennessee Code Annotated, Section 4-21-501, is amended by deleting the language "age or national origin" wherever it appears and by substituting instead the language "sexual orientation, gender identity or expression, age, or national origin". Tennessee Code Annotated, Section 4-21-502, is amended by deleting the language "or national origin" in the fifth line and by substituting instead the language "sexual orientation, gender identity or expression, or national origin". SECTION 8. Tennessee Code Annotated, Section 4-21-502, is amended by deleting the language "age or national origin" and by substituting instead the language "sexual orientation, gender identity or expression, age, or national origin". SECTION 9. Tennessee Code Annotated, Section 4-21-101(3), is amended by deleting the language "age or national origin" and by substituting instead the language "sexual orientation, gender identity or expression, age, or national origin". SECTION 10. Tennessee Code Annotated, Section 4-21-101(3), is amended by deleting the language "or national origin" wherever it appears and by substituting instead the language ”sexual orientation, gender identity or expression, or national origin". SECTION 11. Tennessee Code Annotated, Section 4-21-102, is amended by adding the following language as a new, appropriately designated subdivisions: ( ) "Gender identity or expression" means having or being perceived as having a gender-related self-identity, self-image, appearance, expression or behavior whether or not such gender-related characteristics differ from those associated with the individual's assigned sex at birth. ( ) "Sexual orientation" means having or being perceived as having an orientation for heterosexuality, bisexuality or homosexuality. SECTION 12. Tennessee Code Annotated, Section 4-21-102(4), is further amended by deleting the language "age or national origin" and by substituting instead the language "sexual orientation, gender identity or expression, age or national origin". SECTION 13. Tennessee Code Annotated, Section 4-21-202(16)(A)(i), is amended by deleting the language "age or national origin" and substituting instead the language "sexual orientation, gender identity or expression, age, or national origin". - 3 - 001946 SECTION 14. Tennessee Code Annotated, Section 4-21-601, is amended by deleting the language "or national origin" wherever it appears and by substituting instead the language "sexual orientation, gender identity or expression, or national origin". SECTION 15. Tennessee Code Annotated, Section 4-21-603, is amended by deleting the language "or national origin" and by substituting instead the language "sexual orientation, gender identity or expression, or national origin". SECTION 16. Tennessee Code Annotated, Section 4-21-604, is amended by deleting the language "or national origin" wherever it appears and by substituting instead the language "sexual orientation, gender identity or expression, or national origin". SECTION 17. Tennessee Code Annotated, Section 4-21-606, is amended by deleting the language "or national origin" and by substituting instead the language "sexual orientation, gender identity or expression, or national origin". SECTION 18. This act shall take effect upon becoming a law, the public welfare requiring it.
