Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. GENDER IDENTITY CONTENT DESCRIPTOR FOR 1 VIDEO PROGRAMMING. 2 ‘‘(a) IN GENERAL.—Not later than 90 days after the 3 date of the enactment of this section, the Commission 4 shall— 5 ‘‘(1) determine if the conditions of subsection 6 (b) have been met; and 7 ‘‘(2) if the Commission determines under para- 8 graph (1) that such conditions have not been met, 9 promulgate regulations that— 10 ‘‘(A) establish a content descriptor for 11 video programming that depicts, discusses, or 12 promotes gender identity, gender transition, 13 transgender identity, or non-binary identity; 14 and 15 ‘‘(B) require distributors of video program- 16 ming to transmit the content descriptor de- 17 scribed in subparagraph (A)— 18 ‘‘(i) with any video programming 19 that— 20 ‘‘(I) contains the content de- 21 scribed in such subparagraph; and 22 ‘‘(II) is marketed to children 23 (such as programming that is rated 24 TV–Y, TV–Y7, or TV–G under the 25 TV Parental Guidelines); and 26 VerDate Sep 11 2014 03:22 Jun 06, 2026 Jkt 069200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H9067.IH H9067 mduett on DSK9DHNXB4PROD with BILLS 3 •HR 9067 IH ‘‘(ii) in a manner that, to the max- 1 imum extent technically feasible, can be 2 used with the feature described in section 3 303(x) (commonly known as the ‘V-chip’) 4 and other parental-control technologies. 5 ‘‘(b) VOLUNTARY COMPLIANCE.—The conditions of 6 this subsection are the following: 7 ‘‘(1) The TV Parental Guidelines have been re- 8 vised so as to include a content descriptor for video 9 programming that depicts, discusses, or promotes 10 gender identity, gender transition, transgender iden- 11 tity, or non-binary identity. 12 ‘‘(2) The content descriptor described in para- 13 graph (1) is being consistently transmitted with the 14 rating under the TV Parental Guidelines for video 15 programming that— 16 ‘‘(A) contains content described in such 17 paragraph; and 18 ‘‘(B) is rated TV–Y, TV–Y7, or TV–G 19 under the TV Parental Guidelines or is other- 20 wise marketed to children. 21 ‘‘(c) RULE OF CONSTRUCTION.—Nothing in this sec- 22 tion may be construed to ban or censor any video program- 23 ming. 24 VerDate Sep 11 2014 03:22 Jun 06, 2026 Jkt 069200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H9067.IH H9067 mduett on DSK9DHNXB4PROD with BILLS 4 •HR 9067 IH ‘‘(d) TV PARENTAL GUIDELINES DEFINED.—In this 1 section, the term ‘TV Parental Guidelines’ means the vol- 2 untary ratings (or any successor to such ratings) for video 3 programming maintained by the TV Parental Guidelines 4 Monitoring Board (or any successor to such Board).’’. 5 Æ VerDate Sep 11 2014 03:22 Jun 06, 2026 Jkt 069200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H9067.IH H9067 mduett on DSK9DHNXB4PROD with BILLS
