Summary

Revokes Executive Order 11246 (1965), which — as amended by EO 13672 (2014) — had prohibited federal contractors from discriminating based on sexual orientation and gender identity. Its revocation eliminated the contractor-facing SOGI nondiscrimination and affirmative-action regime administered by OFCCP; contractors were given 90 days (to April 21, 2025) to wind down compliance. Also requires federal contractors and grantees to certify they do not operate "illegal DEI" programs, a certification agencies have applied to transgender-inclusive programming. EO number 14173; 90 FR 8633 (Jan. 31, 2025).

Status

In effect. The NADOHE v. Trump preliminary injunction against the certification and enforcement-threat provisions (D. Md., Feb. 21, 2025) was stayed by the Fourth Circuit March 14, 2025, and vacated by the Fourth Circuit on February 6, 2026 with remand to the district court; certification-clause litigation continues in other courts (see section 10).
