Summary

Secretary Turner directed HUD to "halt any pending or future enforcement actions" under the 2016 Equal Access Rule (81 FR 64763), which had guaranteed access to HUD-funded shelters and housing consistent with a person's gender identity and barred intrusive documentation demands. HUD's announcement (HUD No. 25-026, reported Feb. 7-10, 2025) framed the change as ensuring placements "based on biological sex," permitting HUD-funded single-sex shelters to turn away transgender women from women's facilities. The 2012 Equal Access Rule's sexual-orientation/gender-identity nondiscrimination text remained formally on the books but unenforced.

Status

Enforcement halt in effect; formal rescission/rewrite proposed April 28, 2026 (see that item).
