Summary

Homelessness/civil-commitment order that echoes the administration's EO 14168 sex-definition policy but, per the order's actual operative text (Sec. 5(d)), directs HUD only to revise regulations "to allow, where permissible under applicable law, federally funded programs to exclusively house women and children and to stop sex offenders who receive homelessness assistance through such programs from being housed with unrelated children." EO 14321's text does not itself contain the phrase "designated by sex and not identity" or the "intimate spaces designated for women, girls, or females (or for men, boys, or males)" quote; that operative language is from EO 14168 (Jan. 20, 2025), "Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government," not this order. EO number 14321; 90 FR 35817 (July 29, 2025).

Status

In effect; HUD issued the proposed rule "Equal Access to Housing in HUD Programs Revisions" April 28, 2026 (doc 2026-08244), which implements EO 14168's sex-definition policy in HUD's Equal Access regulations — it is not implementation of a directive contained in EO 14321 (see section 8).
