Summary
In In re Administrative Subpoena No. 25-1431-014 (E.D. Pa. Nos. 2:25-mc-00039, -00054), Children's Hospital of Philadelphia and pseudonymous patient families challenged the DOJ subpoena; on November 21, 2025 Judge Kearney issued a memorandum substantially limiting/quashing it. DOJ appealed to the Third Circuit (No. 26-1134) on January 16, 2026, then voluntarily dismissed its own appeal on May 12, 2026. Separately, the Western District of Washington quashed the subpoena to telehealth provider QueerDoc as overbroad and not issued to investigate genuine FDCA or FCA violations; a subpoena to UPMC was likewise blocked (see 2026-08-10). By May 2026, at least seven federal judges had blocked DOJ administrative subpoenas in the program.
