SUPPLEMENT: THE GOVERNMENT-WIDE CFR 'TERMINOLOGY' RULEMAKINGS ARE ONLY PARTIALLY CAPTURED — TSA'S MAY 2025 FINAL RULE AND THE AUGUST 2026 FDA COMMENT REOPENING ARE MISSING

Summary

The earliest CFR text amendment in the EO 14168 terminology program, and the item most clearly missing from the index. TSA replaces every instance of "gender" (and "Gender") with "sex" (and "Sex") across the regulations it administers: 6 CFR 37.17(c), 37.17(m), and 37.19(e) (REAL ID driver's license and identification card content and source documents); 49 CFR 1500.5(a)(3); 49 CFR 1540.107(b) and 1540.203(c)(5); 49 CFR 1560.3, 1560.101(a)(1), and 1560.101(a)(3) (Secure Flight passenger data elements submitted by aircraft operators); and 49 CFR 1572.9(a)(4) and 1572.17(a)(4) (Hazardous Materials Endorsement and Transportation Worker Identification Credential application content). The practical reach is broad: REAL ID cards, the Secure Flight watchlist-matching data set, and TWIC/HME credentialing all now key on "sex." TSA issued the rule as a technical amendment effective on publication, without notice and comment, finding good cause on the ground that "the revisions are not substantive and will have no impact on the regulatory requirements in the affected parts" and that the change is a rule of agency organization, procedure, or practice.

Status

In effect. Verified against the current Code of Federal Regulations as of August 2026: 49 CFR 1560.101 now reads "the full name, sex, date of birth, and Redress Number." No challenge to this rule was located; see section 10.
