Summary

Declares that "expressing a false 'gender identity' divergent from an individual's sex cannot satisfy the rigorous standards necessary for Military Service," revokes EO 14004 (2021), which had permitted open transgender service, and directs the Secretary of Defense to update medical standards and end "invented and identification-based pronoun usage" in the military. It orders DoD to treat gender dysphoria and a history of gender transition as incompatible with service and to implement facility (berthing, bathroom, shower) access by birth sex. Builds on EO 14168's two-sexes definition (see section 1).

Status

In force as written; found likely unconstitutional as to currently serving members (based partly on animus) by the D.C. Circuit in Talbott v. USA (June 1, 2026), which affirmed the preliminary injunction barring their separation while leaving the accession bar enforceable as to prospective enlistees; enforcement against the certified Talbott class constrained by ongoing litigation (see section 10). Update, Sept. 23, 2026: On Aug. 27, 2026, the government petitioned the Supreme Court for a writ of certiorari to review the D.C. Circuit's June 1, 2026 ruling in Talbott v. USA (docketed Sept. 1, 2026, as No. 26-272; response due Oct. 1, 2026). The D.C. Circuit case is now closed, and the injunction barring separation of currently-serving class members, and the accession bar, remain in effect pending the petition.
